Customers outside Alberta may have additional mandatory rights under the laws of their province, territory, state, or country. These Terms do not limit those mandatory rights where they apply.
5. Eligibility
You may use the Website and purchase products only if you are legally capable of entering into a binding contract.
If you use the Website or purchase products on behalf of a business, organization, or other entity, you represent that you are authorized to bind that entity to these Terms.
6. Product Information and Compatibility
Parts of Canada sells appliance parts and related products. Product descriptions, specifications, diagrams, photographs, packaging images, part numbers, model references, and compatibility information are provided to help customers identify products.
We make reasonable efforts to keep product information accurate and current. However, manufacturers and suppliers may change part numbers, designs, substitutions, packaging, specifications, or compatibility information without notice.
Product images are provided for identification and illustration purposes only. The product you receive may differ in appearance, colour, packaging, labelling, or minor design features, provided that the product is the item ordered, a manufacturer-approved substitute, or otherwise suitable for the stated purpose.
You are responsible for confirming that a product is suitable for your appliance, model, serial number, repair need, and installation environment. Before ordering, you should verify the part number and compatibility using the appliance model number, serial number, manufacturer documentation, or a qualified technician.
If you are unsure whether a product is compatible with your appliance, you may contact us before ordering with your model number, serial number, and any relevant photographs. We will make reasonable efforts to assist, but final compatibility confirmation remains your responsibility.
7. No Installation or Repair Advice
Information on the Website is provided for general product-identification purposes only. Unless expressly stated in writing, we do not provide licensed appliance repair, electrical, gas-fitting, plumbing, HVAC, engineering, or safety-code advice.
Some products may require installation by a qualified or licensed technician. Electrical, gas, heating, refrigeration, and safety-critical components should be installed only by a qualified professional.
You are responsible for ensuring that installation, diagnosis, repair, and use comply with applicable laws, codes, manufacturer instructions, and safety standards.
8. Orders
To place an order, you must provide accurate, current, and complete information, including billing details, shipping details, contact information, and payment information.
Before submitting your order, you are responsible for reviewing all order details, including product, quantity, price, taxes, shipping charges, delivery address, and contact information.
Items placed in a shopping cart are not reserved until checkout is completed and payment is authorized.
9. Pricing, Taxes, and Fees
Prices are displayed in Canadian dollars unless otherwise stated.
We make reasonable efforts to display all mandatory charges clearly before checkout, including product price, applicable taxes, shipping charges, handling charges, and any other mandatory fees.
We may correct errors in pricing, product descriptions, availability, or shipping charges. If an error affects your order, we may contact you for instructions, cancel the affected order, or refund any amount paid for the affected order.
Applicable taxes are calculated based on the shipping destination and applicable tax rules.
10. Payment
We accept the payment methods displayed at checkout, which may include major credit cards, debit cards, and other third-party payment options.
By submitting payment information, you represent that you are authorized to use the selected payment method and that the payment information is accurate.
Payment may be authorized or captured at checkout. If payment is declined, unauthorized, reversed, or suspected to be fraudulent, we may cancel the order or request an alternate payment method.
We may add, remove, or modify accepted payment methods at any time.
11. Order Acceptance and Contract Formation
After you place an order, you may receive an electronic confirmation that we have received your order. This confirmation does not guarantee acceptance of the order.
A binding sales contract is formed only when we accept your order by sending an order confirmation, processing the order for shipment, or otherwise confirming acceptance in writing.
We may refuse or cancel an order where permitted by law, including where:
- the product is unavailable or discontinued;
- payment is declined, unauthorized, reversed, or suspected to be fraudulent;
- there is an error in price, description, availability, or listing information;
- shipping to the requested location is unavailable or impractical;
- the order appears to be for resale, abuse, fraud, or unlawful purposes;
- the product is subject to legal, regulatory, safety, or manufacturer restrictions; or
- you do not meet eligibility requirements.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order or cancelled portion of the order.
12. Internet Sales Contract Information
For online consumer purchases that qualify as internet sales contracts under applicable Alberta law, we will provide the required contract information in electronic form, including supplier identity, contact information, product description, price, applicable taxes, shipping charges, total cost, payment terms, delivery information, cancellation rights where applicable, and any other required information.
Where applicable law requires us to provide a copy of the contract, the order confirmation and related transaction records sent to the email address provided at checkout will serve as the contract copy unless a different form is required by law.
If you believe you did not receive required contract information or a copy of your contract, contact us promptly at support@partsofcanada.ca.
13. Customer Cancellation Requests
You may request cancellation of an order by contacting us as soon as possible at support@partsofcanada.ca.
We will make reasonable efforts to cancel an order before it is processed, picked, packed, special-ordered, or shipped. However, orders that have already been processed, prepared for shipment, special-ordered, or shipped may not be cancellable.
Where a cancellation is requested before processing and no special-order or non-recoverable cost has been incurred, we will cancel the order and refund the amount paid.
A cancellation or restocking fee may apply only where permitted by law and disclosed before purchase. No cancellation or restocking fee will apply where the customer exercises a mandatory statutory cancellation right, where we are required by law to refund the amount paid, or where the cancellation is due to our error.
14. Statutory Cancellation Rights
Some customers may have statutory cancellation rights under applicable consumer protection laws, including rights related to internet sales contracts where required information is not provided, a contract copy is not provided within the required time, delivery does not occur within the required or agreed time, or other statutory conditions are met.
Where you validly cancel under a mandatory statutory right, we will provide the refund required by applicable law within the legally required period.
These statutory cancellation rights are separate from, and may override, our ordinary cancellation, return, or restocking policies.
15. Shipping and Delivery
Shipping options, estimated delivery timelines, carriers, charges, and restrictions are displayed at checkout or in our Shipping Policy.
Delivery timelines are estimates only unless we expressly guarantee a delivery date in writing. Delivery may be affected by carrier delays, customs processing, weather, labour disruptions, supplier delays, address errors, remote locations, or events beyond our reasonable control.
Risk of loss or damage passes to you when permitted by applicable law. For consumer transactions, nothing in this section limits any mandatory delivery, cancellation, or refund rights you may have under applicable law.
You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, non-delivery, or additional costs caused by incorrect or incomplete shipping information provided by you.
Where applicable consumer protection law gives you the right to cancel because goods are not delivered within the required or agreed delivery period, you may exercise that right by contacting us at support@partsofcanada.ca. If you validly cancel under a mandatory statutory delivery right, we will provide the refund required by applicable law within the required period.
16. Inspection Upon Delivery
You should inspect all products promptly upon delivery.
If a product arrives damaged, defective, missing parts, incorrect, or materially different from what you ordered, contact us as soon as possible at support@partsofcanada.ca. Please include your order number, a description of the issue, and photographs where applicable.
Failure to notify us promptly may affect available remedies, except where prohibited by law.
17. Returns and Refunds
Returns and refunds are governed by our Returns and Refunds Policy, as updated from time to time, and by applicable law.
Unless otherwise required by law or expressly approved by us, products may be ineligible for return if they are:
- installed, used, damaged, altered, or tampered with;
- electrical or electronic components that have been opened, installed, or connected;
- special-order, final-sale, discontinued, or non-returnable items clearly identified as such before purchase;
- missing original packaging, labels, instructions, or included components;
- returned without required authorization; or
- outside the stated return period.
A Return Merchandise Authorization or return approval may be required before returning a product. Unauthorized returns may be refused or delayed.
Approved refunds will be issued to the original payment method unless otherwise agreed. Shipping charges, return shipping charges, handling charges, and restocking fees may be non-refundable where permitted by law and disclosed before purchase.
Nothing in this section limits your statutory rights for defective products, incorrect products, misdescribed products, or mandatory cancellation rights.
18. Defective Products and Warranty Claims
Some products may be covered by a manufacturer warranty, supplier warranty, or our limited warranty if expressly stated.
Warranty coverage, duration, exclusions, and claim procedures may vary by product. Warranty claims may require proof of purchase, product photographs, diagnostic information, return of the product, manufacturer inspection, or confirmation that the product was installed and used correctly.
Warranty coverage may be denied where the product failure is caused by improper diagnosis, incorrect installation, misuse, abuse, modification, power surge, water damage, external damage, incompatible appliance model, failure to follow manufacturer instructions, or installation by an unqualified person where professional installation was required.
Nothing in this section excludes any non-excludable implied conditions, warranties, or remedies that apply under applicable sale of goods or consumer protection laws.
19. Buyer Responsibilities
You are responsible for:
- diagnosing the appliance issue correctly;
- confirming the correct part number, model number, and serial number;
- reviewing product descriptions and compatibility information before purchase;
- consulting the appliance manufacturer or a qualified technician where needed;
- ensuring safe and lawful installation;
- following manufacturer instructions and applicable codes;
- retaining proof of purchase; and
- contacting us promptly if there is an order issue.

We may suspend or terminate accounts where we reasonably believe there has been fraud, abuse, unauthorized access, violation of these Terms, or unlawful activity.
21. Permitted Use of the Website
You may use the Website only for lawful purposes and in accordance with these Terms. You must not:
- use the Website in a way that violates any law or regulation;

By submitting User Content, you represent that:
- you own or have the right to submit the content;
- the content is accurate to the best of your knowledge;
- the content does not infringe any third-party rights; and
- the content does not violate these Terms or applicable law.
- You must not submit User Content that is defamatory, abusive, hateful, discriminatory, obscene, threatening, misleading, fraudulent, private, confidential, infringing, unlawful, or harmful.
- You grant Parts of Canada a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, adapt, and distribute your User Content for Website operation, customer support, product improvement, marketing, legal compliance, and related business purposes.
We may moderate, edit, refuse, or remove User Content where we believe it violates these Terms, applicable law, or our business standards.
23. Intellectual Property
The Website and its content, including text, images, graphics, product listings, layout, logos, trademarks, trade names, software, code, icons, photographs, video, audio, and design elements, are owned by or licensed to Parts of Canada and are protected by Canadian and international intellectual property laws.
You may use Website content only for personal product-research and purchasing purposes. You may not copy, reproduce, distribute, modify, scrape, publish, transmit, display, sell, reverse engineer, or commercially exploit Website content without our prior written consent.
All rights not expressly granted are reserved.

24. Third-Party Links, Suppliers, and Services
The Website may include links to third-party websites, manufacturer resources, payment processors, shipping providers, embedded tools, or other third-party services.
We are not responsible for third-party websites, services, policies, products, representations, errors, delays, or failures. Your use of third-party services may be governed by separate terms and privacy policies.
25. Privacy and Cookies
Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy.
By using the Website, creating an account, placing an order, or contacting us, you acknowledge that we may collect and use personal information for purposes such as order processing, payment processing, shipping, fraud prevention, customer support, account administration, legal compliance, analytics, and service improvement.
We use cookies and similar technologies as described in our Cookie Policy. Where required by law, we will request consent for non-essential cookies or similar tracking technologies.
26. Electronic Communications and Marketing
By placing an order, creating an account, or contacting us electronically, you agree that we may communicate with you electronically about your order, account, customer service requests, legal notices, policy updates, and transactional matters.
We may send commercial electronic messages only where permitted by Canada’s anti-spam laws or other applicable laws. Where required, we will obtain consent and provide an unsubscribe mechanism.
You may unsubscribe from marketing communications at any time by using the unsubscribe link or contacting us. Transactional or legally required communications may still be sent where permitted by law.
27. Reviews, Advertising, and Product Claims
We aim to ensure that our advertising, product listings, pricing, availability statements, and promotional claims are accurate and not misleading.
Prices, discounts, promotions, availability, shipping estimates, and compatibility information may change without notice before order acceptance.
If we discover a material error, we may correct it and, where required, contact affected customers or cancel and refund affected orders.
28. Disclaimers
To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis.
We do not guarantee that the Website will be uninterrupted, secure, error-free, virus-free, or always available.
We do not guarantee that Website content, product information, compatibility information, or manufacturer information will be complete, current, or error-free, although we make reasonable efforts to maintain accurate information.
No statement on the Website should be treated as professional repair, electrical, gas-fitting, plumbing, engineering, or safety advice.
Nothing in these Terms excludes warranties, conditions, rights, or remedies that cannot be excluded under applicable law.
29. Limitation of Liability
To the fullest extent permitted by applicable law, Parts of Canada and its directors, officers, employees, contractors, suppliers, service providers, and agents will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or economic damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, appliance damage, property damage, or costs of substitute goods or services arising from or related to your use of the Website, purchase of products, installation of products, or these Terms.
To the fullest extent permitted by applicable law, our total liability for a claim related to a product will not exceed the amount you paid to us for the specific product giving rise to the claim.
This limitation does not apply where liability cannot be limited by law, including liability for fraud, wilful misconduct, gross negligence, or mandatory statutory remedies.
30. Installation, Use, and Safety Liability
Parts of Canada is not responsible for damage, injury, loss, or expense resulting from incorrect diagnosis, incorrect part selection, improper installation, unsafe repair practices, misuse, modification, failure to follow manufacturer instructions, or installation by an unqualified person.
Where a product requires professional installation, you are responsible for hiring a qualified or licensed technician.
31. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Parts of Canada and its directors, officers, employees, contractors, suppliers, service providers, and agents from and against claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from:
- your breach of these Terms;
- your misuse of the Website;
- your unlawful conduct;
- your User Content;
- your infringement of third-party rights;
- your incorrect installation, use, modification, or resale of products; or
- your fraud, misrepresentation, or abuse of our policies.
This indemnity does not apply to the extent prohibited by applicable law.
32. Chargebacks and Payment Disputes
If you have a concern about an order, product, charge, delivery, return, or refund, you should contact us first at support@partsofcanada.ca so we can attempt to resolve the issue.
We may dispute chargebacks that we believe are incorrect, fraudulent, abusive, duplicative, or inconsistent with applicable order records, delivery records, return records, customer communications, and payment processor rules.
Nothing in this section limits any rights you may have under applicable law or applicable payment-card network rules.
Excessive, fraudulent, or abusive chargebacks may result in account suspension, cancellation of pending orders, or refusal of future service where permitted by law.
33. Suspension and Termination
We may suspend, restrict, or terminate your access to the Website or your account where we reasonably believe that you have violated these Terms, engaged in fraud or abuse, created legal risk, interfered with Website operations, or acted unlawfully.
Upon termination, your right to use the Website will cease immediately.
Sections relating to payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and any provisions that by their nature should survive will survive termination.
34. Force Majeure
We will not be liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, pandemic, labour dispute, supplier delay, carrier delay, war, terrorism, civil unrest, government action, power outage, telecommunications failure, cyberattack, payment processor failure, or other events beyond our reasonable control.
35. Changes to Products, Services, and Website
We may add, modify, suspend, discontinue, or remove products, services, Website features, content, or promotions at any time without notice, subject to applicable law and any accepted orders.
36. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Website with a revised effective date.
Changes will apply prospectively unless otherwise stated or required by law.
Your continued use of the Website after updated Terms are posted constitutes acceptance of the updated Terms, subject to applicable law.
37. Dispute Resolution
If a dispute arises, you agree to contact us first so that we can attempt to resolve the matter informally.
Both parties agree to attempt good-faith resolution before starting legal proceedings, except where urgent relief, debt collection, fraud prevention, chargeback response, intellectual property protection, or other immediate legal action is reasonably necessary.
This informal resolution process does not prevent a consumer from exercising any mandatory statutory right or remedy.
Nothing in this section limits any mandatory consumer rights or remedies available under applicable law.
38. Governing Law and Jurisdiction
These Terms and any dispute arising from or relating to the Website, products, orders, or services will be governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any mandatory consumer protection laws that provide otherwise, the courts of Alberta will have exclusive jurisdiction over disputes arising from or relating to these Terms, the Website, products, orders, or services.
39. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
40. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign, transfer, subcontract, or delegate our rights and obligations under these Terms in connection with business operations, restructuring, merger, acquisition, sale of assets, or use of service providers, subject to applicable law.
41. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
A waiver must be in writing and signed by an authorized representative of Parts of Canada.
42. Product-Specific and Policy-Specific Terms
If a product page, checkout page, order confirmation, or written customer-service communication includes specific terms for a product or order, those order-specific terms will apply to that product or order to the extent they are more specific than these Terms, provided they do not limit any mandatory rights you may have under applicable law.
If there is a conflict between these Terms and a policy referenced on the Website, these Terms will apply unless the referenced policy provides more specific terms for shipping, returns, refunds, warranties, privacy, cookies, or another operational matter.
Nothing in any policy limits mandatory rights that cannot be limited under applicable law.
43. Entire Agreement
These Terms, together with the policies referenced in them, form the entire agreement between you and Parts of Canada regarding your use of the Website and purchase of products from us.
They replace all prior communications, proposals, representations, and agreements relating to the same subject matter, except for order-specific terms expressly confirmed by us in writing.
